<p class="MsoNormal"><span style="font-size:11.0pt"> Just wanted to put some sunshine out there. I’ve got an edge case application with a surname refusal. The non-exhaustive list of factors could (arguably) be decided either way based on the
facts and circumstances. I’ve had the USPTO examining attorney reach out, unsolicited, twice to talk about the substance of my OA response (and its 480 pages of evidence) and peel back the curtain to show their thinking. The conversations were excellent and
substantive. Even if they aren’t persuaded by my arguments and evidence, I feel like my client has had their day in court.

<p class="MsoNormal"><span style="font-size:11.0pt"> This comes on the heels of another EA reaching out regarding a description of goods in a very technical field and having a frank conversation about the situation. I was able to help them better
understand the client’s goods and services and move a suite of marks forward quickly and efficiently. That EA was professional, pleasant to work with, and helped repair my opinion of the USPTO. <o:p></o:p></span></p>
