<p class="MsoNormal">Here\u2019s a question! You *know* that the examiners are just throwing \u201cword\u201d into Google translate and perhaps a few other master translation sites. There are over 7000 languages currently spoken (though some are more \u201calive\u201d than others)
but if the demand is to say what it is in *<b>any* </b>language, what they\u2019re doing is turning Google translate with its 243 languages into the Lord G-d of World Languages. Or to put it another way, I could select a mark one of the thousands of languages not
covered by any of the online mass translation programs and slip it right on through assuming the examiner didn\u2019t catch it OR pick a word that is totally randomly generated but means something specific in a number of not-public-mass-translation-website languages
and it would go on through with a good faith statement that the word doesn\u2019t mean anything in any language. Or what about a super-rude motion mark in one of the thousands of sign languages that I know aren\u2019t in the database or any database that anyone not
an expert\u2019s expert would have access to? Almost every culture has its own sign language, most of which are extinct or almost extinct. Sure, the PTO might have some way of running a motion mark made of gestures past an ASL or BritishSL translator but Zimbabwe
sign\u2026? Brazilian SL?<o:p></o:p></p>

<p class="MsoNormal">So the whole thing is VERY ARBITRARY is what I\u2019m saying, this requirement.

Applicant to the $100 <u>per-class</u> fee. The asserted 'remedy' is that Applicant can complain that the Office is not being consistent. Which, of course, is not actually the problem at hand. The non-standard text marks are, in general, different, and will
have different descriptions. So consistency is not the issue -- it's imposing unpredictable fees based on a difference of opinion. [Comment 36 below.]<o:p></o:p></p>

"detect language. Same for Catalan. But if you happen to know it's also a word in Spanish, it's "cassette" (same for many languages). Or maybe if you search Romanian, it's "tapes." Or in Breton & Dari, it's "box." <o:p></o:p></p>

in a significantly different manner in different cases, subject to requirements on the Consistency Initiative page on the USPTO website at

surcharge and submission of the translation and/or transliteration, as appropriate. If the initial application includes a translation or transliteration, the surcharge will not apply for later amendment of the translation or transliteration. The surcharge
