<p>As for point 2, I appreciate that as practitioners we naturally
hope to figure out workarounds so that important tasks will not
grind to a halt on January 18. <br>
</p>
<p>But I sure hope that we (and the Trademark Office) would not
think of a workaround like this as anything other than a very
temporary placeholder until a rather urgent bug fix gets carried
out and tested by users and endorsed by users and only then
crossed off the bug list.</p>
<p>Imagine how this workaround could get less and less
satisfactory. A multiclass application, for example. The client
would be stuck having to receive the "click here" email, click on
the link, open up the to-be-signed application on one computer
screen, then receive a second email with a number of image
attachments, and open up the image attachments on a second
screen. Then the client would need to click and scroll across two
computer screens to try to match things up. Depending on the
number of classes, this might take a while it might sometimes be a
challenge knowing how to match things up on the two computer
screens.</p>
<p>Not only that, but supposedly the Trademark Office thinks that
more and more filers don't even use computers but just click
around on their smart phones to carry out e-signing processes. I
cannot imagine how a person using a smart phone would be able to
fulfill the requirements of this kind of workaround.</p>
<p>When the USPTO was constructing its then-new Patent Center, and
then announced that it was going to shut down the legacy systems
(EFS-Web and PAIR), the patent practitioner community pointed to
the bug list at <a
href="https://patentcenter-tickets.oppedahl.com/"
class="moz-txt-link-freetext">https://patentcenter-tickets.oppedahl.com/</a>
. After a year there are still over two hundred bugs that the
Patent Office has not fixed. Things are so bad with the Patent
Center system that users have, I think, sort of despaired at the
question of whether the Patent Office will ever get it working
right. These days for example, the Patent Center system randomly
logs users out in the middle of complex filing projects.</p>
<p>The Patent Office people claim to be interested in hearing about
what features the practitioner community would like to see
implemented in Patent Center. And we have duly compiled a list of
over fifty feature requests ( <a
href="https://patentcenter-tickets.oppedahl.com/patentcenter-feature-requests/"
class="moz-txt-link-freetext">https://patentcenter-tickets.oppedahl.com/patentcenter-feature-requests/</a>
). Many of these feature requests have been outstanding for over
three years. Now after well over three years, <i><b>not one
feature request</b></i> has been implemented.</p>
<p>At this point I wonder whether the trademark practitioner
community might want to compile a bug list. Unfortunately (and
probably very deliberately, on the part of the Trademark Office)
it is likely impossible to compile a thorough enough bug list soon
enough (what with Thanksgiving holidays and the December holidays
coming up) to have a meaningful chance of deflecting the Trademark
Office from its stated plan of shutting down TEAS on January 18. <br>

question about the new application form in TM Center
Beta. My paralegal and I have been tentatively trying it
out, and we did (or tried to do) our first use-based
application today. And when I received the link to review
prior to sending to the client for e-signature, I was
surprised that I was unable to view the specimen that had
been uploaded. Am I missing something? My paralegal
called the Trademark Assistance Center and they confirmed
that only the person who prepared the form (my paralegal)
can see the specimen; anyone to whom she forwards the link
cannot.</span></p>

is expecting applicants (whose applications are prepared
by outside counsel) to sign something under the pains and

space, I get this question about a lot of various
companies. I\u2019ll address it as to \u201cLegalZoom,\u201d which
is what you specifically asked. </p>

filings from that company, my understanding is
that they are in fact coming from a real law firm\u2014 LZ
Legal Services. These applications are reviewed and
filed by real lawyers. Therefore, they are permitted
to practice just like you and I would be.</p>

<p class="MsoNormal">On the other hand, I also get asked
about other online filing providers where the
applicant never speaks to an attorney, and they are
filed \u201cpro se.\u201d Many members of this listserv likely
receive clients who get Office Actions associated with
those filings, and my understanding is those types of
companies do not do Office Action responses, and don\u2019t
otherwise have attorneys involved in the process.</p>
<p class="MsoNormal"> </p>
<p class="MsoNormal">As to why the USPTO has not taken
action against those (latter) companies who are
filing pro se marks\u2014my guess is as good as yours.
However, one can surmise that they are busy focusing
on solo practitioners who work with applicants from
China. For those of you that don\u2019t know, Brad Behar,
outside counsel for Amazon, has been filing
\u201canonymous\u201d grievances with the USPTO against almost
twenty trademark lawyers. Contrary to what Amazon
says, it appears that they do maintain a blacklist,
and do take action against those who complain about
being put on the blacklist.</p>

correctly, she was indicating that most applications
are filed either by pro se filers OR by attorneys
who aren\u2019t TM specialists. I\u2019d still be surprised
if the percent of knowledgeable filers was as low as
Pam mentioned, but given the quality of the filings
I\u2019ve seen in a lot of my searches, it wouldn\u2019t
surprise me if more than 50% of filers are either
pro se or lawyers who \u201cdabble\u201d in trademark law. If
you add in the trademark mills, that percentage
could be substantially higher.</p>

and/or one raised in a search-- I look to see
who filed the application etc. as part of my
analysis. While this is not a scientific
method, I would say that it is more like 85%
of applications and registrations I need to
look at in more depth are filed by a trademark
practitioner. Of course, under current rules
ANY application (or maintenance document)
filed on behalf of a non-U.S. owner, must be
filed by a U.S. attorney. That alone would
seem to raise the numbers. What are others
seeing in terms of likely percentage of
applications filed by IP attorneys?</p>

time what their estimate was on the number
of applications they process that are from
experienced trademark attorneys, rather than
pro se or the passing lawyer who does
applications as part of their general
practice. Their estimate was 15%. We are a
very small part of the user base and they
won't be optimizing for us.</p>
