Dear TM colleagues,<br><br>
I recall in my long ago Wall Street days a certain snootiness about DoJ
antitrust attorneys -- heck, they mostly didn't even go to Yale! (Neither
did I). <br><br>
I was never one to dis hardworking government employees, working in
service of the public good. But lately I've gotten some very peculiar
Refusals to register and other plain ol' errors:<br><br>
- a refusal based on the current application being identical to an
existing registration. BUT IT WASN'T IDENTICAL (it was a whole word
different). A formal response corrected the problem, but how
exhausted did the Examiner need to be to make that mistake?<br><br>
- a refusal based on using an accommodation address. BUT IT'S
REAL OFFICE ADDRESS -- I was there! I can give my own certification
as to its genuineness. And will something more be needed (a
photograph of the Office door)?<br><br>
- a Notice of Allowance issued despite the fact a Statement of Use
had been accepted. A polite informal communication corrected the
problem, but subject to republication and the delay that will
incur. (The Examiner did send me an email apologizing for
that).<br><br>
- my ongoing battle to get an application canceled that was filed
in 2021 (because it's a barrier to my client's later application).
So far, no Examiner has been appointed (although the application is now
formally "suspended" pending a possible Order to Show cause
related to a fake attorney being listed in the application).<br><br>
I know we're living in -- let's just say unprecedented times. But
as we say in New York City, "whatup?"<br><br>
