<p class="MsoNormal"><span style="font-size:12.0pt;font-family:"Arial",sans-serif">I know folks on this list occasionally like to complain about poor refusals, but CIPO just issued the worst I’ve seen in a while. Rejected a mark that is a common plant name
(not being used for plants) plus some descriptive words because the examiner found a single town in PA (population less than 500) with the same name, so the mark is “clearly” geographically descriptive. Never mind that we already own a word mark registration
just of the name, with no additional words, plus one of the name plus some different descriptive words. And never mind that Wikipedia even says the town was named after the plant. Oy.<o:p></o:p></span></p>
