Do we know who the firm is that the USPTO has been paying so much (6X over budget now) for the Patent Center? Or for DOCX? (Just Microsoft?) Are there any curious apparent conflicts of interest, close associations with foreign powers or other US-patent-hostile entities, or other red flags that should make us question what is going on even more strongly? I’ve been reading about one of the great government-business partnerships, that of NASA and Morton Thiokol, in Allan McDonald's Truth, Lies, and O-Rings, the story of the misaligned incentives and apparent greed that cost the lives of the crew of the Challenger Space Shuttle mission in 1986. Government officials and corporate executives felt great pressure (based on their own incentives) to launch under dangerous conditions when key engineers like Allen McDonald refused to sign off on the launch due to safety concerns. They were overruled and nearly silenced in an ugly coverup, were it not for McDonald's courage to speak out as a whistle blower. The rush to launch really bother me when I think about this book.

Just as engineers at Morton-Thiokol were demanding that the Jan. 1986 launch be delayed because the conditions were not right for launch and there were of genuine concerns about the potential failure of the system due to O-ring trouble, so also the "engineers" of the patent system -- the IP workers who rely on that software for many aspects of their work and apparently some internal EBC  staff at the USPTO -- have been warning against the launch of the Patent Center as the sole software platform for patent work due to many bugs that are far easier to see than the subtle problems with O-rings on the solid rocket motors of the Challenger.

If the US patent system "blows up," it's not going to kill anybody directly, but it could have a lasting and serious impact on many inventor and businesses whose IP rights may be jeopardized and whose legal costs will certainly increase. Listen to the engineers!

Thank you for the explanation.

It is curious that extensions in all caps were previously accepted (and are still accepted in EFS).  Seems to be a simple fix that the USPTO could do, i.e., allow file extensions to be in all caps.

Practitioners often receive files from their clients (as was my situation) and it is quite inconvenient to check the file extensions.

Do note that the FILENAME does not refer to the file extension.

Also note that the warning indicator should be a bit more informative to indicate that the extension is in all caps and should be changed to lowercase (should the USPTO not be willing make such a small change that would be appreciated by most all practitioners).

Crying out loud… I’ve been too busy to read the posts… thought it was just the file name itself, not the extension… and WHY does the ERROR not indicate the issue is with the EXTENSION ITSELF.  The file extension is NOT part of the filename.

Yes, it's ridiculous.  There were several emails about this on the list serve over the past few days.  The lower case requirement for lower case file extensions like .pdf has been in effect since at least 2011, but they just started enforcing it in Patent Center on November 1.  The Patent Center main page now contains this notification at the top of the page:


  *   IMPORTANT Some filers are experiencing a “File naming convention error” when uploading files in Patent Center. The filename extension must be lowercase (e.g. .docx) to be compatible with other USPTO systems. This has always been the rule and is now enforced in Patent Center.  Please go to the “File Naming Convention<https://www.uspto.gov/patents/apply/applying-online/files-be-submitted-naming-pdf-files>” page for details.

Dear Kimberly,

Wondering if you have any information on the provisional application issues I identified.  Please advise.

Additionally, I just attempted to file an Information Disclosure Statement (IDS) in PatentCenter for 17/209,035 and was unable to because I received a filename in convention in error.  Those on the list served indicated that they were receiving such errors when they used capital letters.  Therefore, I renamed my file with all lowercase letters and still received an error.  I then renamed it to be “1” and then “a”, and both were still rejected.  See below.

Clearly, this file naming problem is critical to being able to use PatentCenter for filings.

I am reporting to EBC via copying EBC on this email.
