[E-trademarks] Hivemind thoughts on the Luke Combs counterfeiting case?

I believe Eric Goldman has also written about the attached decision, but providing it so that more people have access to it to use in aid of defending theses cases.    (My client was similarly situated to the Luke Combs case -- he had sold an accused $201.50 in sales but plaintiff held $25k hostage in a Paypal account.)  Through my fee motion pursuit, I intend to try to learn the manner of investigation the plaintiffs engage in pre-suit and anticipate briefing that for the Court.

Hi Tim, I can’t get to those cases unless I create a Blue Sky account. But do attorneys who take these cases know about these problems with their modus operandi and just not care, a la Richard Liebowitz, the king of the copyright trolls? (Liebowitz has actually been prohibited from representing copyright plaintiffs in certain jurisdictions, but only because enough defendants took the time, trouble and money to hold him to account.) I’m betting they don’t follow Eric Goldman.

Thanks.  I read about this case.  Hadn’t seen the article, but I had the same thought—it was a bit weird that Combs apparently didn’t know who he was suing.  I also thought it was kind of crazy that he got default judgments for $250K in statutory damages.  I realize that statutory damages aren’t the same as actual damages, but it was my recollection from my litigation days that even if you got a default judgment you still had to put on evidence of what your damages actually were.  Hard to see how a court actually hearing about a counterfeiter with a couple of hundred dollars in sales would have awarded a $250K judgment.
