With all due respect to my counterpart professionals, is this really a First Amendment concern or is it really about trademark practitioners biting at the bit to be able to file whatever marks for whatever product or service regardless of the legal, moral or other issues regarding that product or service?  The reality is that there is a lot of $$$$ on the line: I can only imagine the thousand and thousands of trademark applications that would be filed if the door were open for marijuana and illicit drugs, not to mention other products and services.  How about THE LAUNDRY for laundering money?  TAKE’M OUT for a hitman business?  Yes, I am being facetious; but, how far are we from this?  Is not the driving force behind this question really a matter of money as opposed to freedom of speech?

I don’t think the First Amendment would be implicated in a direct challenge. It’s an ultra vires rule without any textual support from the Lanham Act. No need to base it on 1A.

No. Reclassifying into Schedule III qualifies cannabis for use in approved pharmaceutical formulations. The USPTO will pivot to issuing the FDCA refusals that hemp companies now receive. Certain psychedelics should be the only substances still receiving CSA Schedule I refusals (for now).
