Question: What would you expect to see in a registered trademark that was terminated via the USPTO's actions for this theme? I'll admit that I don't know. Maybe something in the correspondence that a section 7 submission was rejected? In any case ...
At some point in the last year, I questioned whether anyone had found any use for the GS3 search field. No one volunteered any comments. Well, here is one of the searches I generated towards finding live trademarks with longer GS entries.
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true
Basically, I searched for multiple occurrences on the semicolon character (;) in live GS entries.
Today, if you get that search to finish, versus receiving the dreaded Sorry, something went wrong. This is all we know error, you'll retrieve 1525 live trademarks. Changing the last criterion from LD:true to LR:truereduces the retrieved count to 992 live registered trademarks. In either case, these tend to be trademarks with longer GS entries, as for at least one GS entries will have lots of semicolons.
In my notes, at one time (probably before March, 2024), that search retrieved 1527 trademarks.
Recall that for registered trademarks, when a GS entry is revised (i.e., one or more ID is deleted), the semicolon count doesn't change, but [ and ] are placed around the deleted ID text. While that's a simplified generalization of the process, the decrease of live hits for that search suggests the USPTO has terminated some of the trademarks since I first performed that search, and that some of the terminated trademarks may be relevant to this discussion.
Again, I don't really know what to look for in such in the TSDR correspondence or TSDR prosecution history for such a terminated trademark. Revising that original search slightly, I performed a new search today, namely
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false AND UD:[20240301 TO *]
was performed today. That search retrieved 336 trademarks. I figured the non-registrations of that search would not be too interesting for this theme, but what do I know? In any case, you could try that search, hoping you do NOT get the dreaded Sorry, something went wrong. This is all we know error, or you could try searching
RN:( 1803208 1806148 3187511 4373191 4405200 4422458 4470302 4490488 4523215 4643091 4683225 4683226 4766423 4843294 4872332 4872398 4872399 4876438 4890793 4916106 5084083 5097707 5111679 5116436 5121507 5148464 5148542 5163504 5173569 5206710 5211392 5215623 5215627 5225236 5243446 5244893 5249245 5249603 5258829 5263353 5273472 5273478 5280115 5280223 5280261 5287958 5288115 5288199 5296081 5303924 5317828 5322383 5327832 5332050 5334642 5341719 5344509 5348136 5352495 5356173 5361191 5361877 5361988 5362565 5365495 5372024 5373671 5378233 5383730 5384511 5388971 5395741 5398488 5403386 5403841 5404904 5408758 5408759 5414755 5420376 5423415 5424616 5425187 5426901 5429426 5430418 5430446 5430550 5439212 5440444 5440560 5445523 5446260 5455713 5459509 5462794 5463799 5466774 5472513 5476674 5482335 5504751 5746593 5840460 )
to analyze any of the 104 longer registrations updated since March that are now dead to determine what key feature of those registrations relevant to this TMA proceedings indicate the terminated registration is relevant to this theme. Happy hunting! I'm looking forward to your replies.
Hope this helps,
Ken Boone
PS: Adding one more occurrence to the \;.* sequence causes a search error, as I recall. That's somewhere around 1000 characters in that search term, presumably the upper limit of that search syntax. That's somewhere around at least 249 semicolons in at least one GS entry for the trademarks retrieved, but please feel free to count the semicolons for yourself. The trademarks retrieved tend to have at least one long GS entry. The PS4 trademark (SN 79224108 - https://tsdr.uspto.gov/#caseNumber=79224108&caseSearchType=US_APPLICATION&caseType=DEFAULT&searchType=statusSearch) by Sony Interactive Entertainment Inc. is among the more famous longer trademarks, though I was not familiar with most of the retrieved trademarks.

This is really a BS announcement on the part of the PTO - They really just cleared out long specifications that shouldn't have been approved in the first place, and were likely never in use because of the historically lax specimen review. Of course these specs weren't cleared until someone had to come along and spend the money to file the TMA action in the first place.....

I am sure it means individual listed items (but could even include "characters" in an id since that is the new standard). Number of registrations cancelled/partially cancelled would be a more useful metric.

"cleared over 25,000 goods and services" - what does that mean? Not registrations, or they would have said. Classes? Individual items?

Successfully clearing the trademark register using TMA proceedings
[tm-celebrating-25-canceled-banner]
We’ve hit a huge milestone—the Trademark Modernization Act’s (TMA) expungement and reexamination proceedings have cleared over 25,000 goods and services from the trademark register. We couldn’t have done it without you. Your petitions helped us identify and clear unused goods and services that blocked other innovators from registering their trademarks.
To obtain and maintain a registration, business owners must use their trademark in commerce for all the goods and services in the registration. When registered trademarks aren’t used but remain on the register anyway, they clutter the trademark register, making it difficult for legitimate businesses to obtain their own registrations for the same or similar marks.
If you’d like to request an expungement or reexamination proceeding<https://links-1.govdelivery.com/CL0/https:%2F%2Fwww.uspto.gov%2Ftrademarks%2Fprotect%2Frequesting-expungement-or-reexamination-proceeding%3Futm_campaign=subscriptioncenter%26utm_content=%26utm_medium=email%26utm_name=%26utm_source=govdelivery%26utm_term=/1/01000193c059720a-e0fc7364-6a53-4522-903e-14b4611624b9-000000/skwyGV8tNO3I2TRvFaNg1i9M9v7IsoY4JVznIzNBGM4=383>, submit a petition and filing fee.
