[E-trademarks] Your morning dose of schadenfreude

Agreed. I do have a question, though, concerning sanctions: it has always been my understanding that neither the TTAB nor the PTAB could award monetary sanctions, but I recently read a decision by the Director in a patent case awarding attorneys fees. I’m not sure of the statutory basis for that award, but I wonder if that might not be available in Trademark cases as well.

But why not, if you're Monster Energy? You gain a reputation as a litigant, therefore giving anyone pause who thinks of using MONSTER (or apparently now BEAST) for anything all all. You know the cost of your registration is going to include an opposition by the TTAB and few are going to elect that choice. There's no sanction at the TTAB, although in this case if it was federal court I think there would be a good basis for sanctions. Monster Energy has nothing to lose.
