[E-trademarks] Your morning dose of schadenfreude

"[T]he United States Patent and Trademark Office (“USPTO” or “Office”) 
promulgated Rule 42.12, which expressly authorizes the Patent Trial and 
Appeal Board (“PTAB” or “Board”) to issue sanctions to punish and deter 
a wide range of misconduct. 37 C.F.R. § 42.12. Those sanctions include, 
among others, an award of “compensatory expenses, including attorney 
fees.” 37 C.F.R. § 42.12(b)(6). The Court of Appeals for the Federal 
Circuit has recognized this regulatory power to award attorney fees as a 
“means for regulating litigation misconduct.” /See Amneal 
Pharmaceuticals LLC v. Almirall, LLC/, 960 F.3d 1368, 1372 n.* (Fed. 
Cir. 2020) (“§ 42.12 allows the Board to impose sanctions including 
‘attorney fees’”)."
