NantKwest was construing 145, whose sole statement that could be relied on
for sanctions is "All the expenses of the proceedings shall be paid by the
applicant," with no mention of sanctions.
316(a)(6) is much more explicit: "The Director shall prescribe
regulations... prescribing sanctions for abuse of discovery, abuse of
process, or any other improper use of the proceeding, such as to harass or
to cause unnecessary delay or an unnecessary increase in the cost of the
proceeding". It much more clearly addresses sanctions and expressly
authorizes the Director to promulgate regulations in support of
sanctions, including of the sort awarded.
I suppose it's possible that NantKwest's construction of 145 could be
stretched to reach 316, but it's not at all clear that a court would do
that.
