Especially if the client wants to avoid paying for both lead counsel and local counsel, it will be important to determine which courts have jurisdiction and then seek counsel there.

Generally (disclaimer that this is very fact specific), if the infringer is selling products into Massachusetts or knows that it is causing harm in Massachusetts, there may be jurisdiction there. Otherwise, and to avoid the costs associated with a motion to dismiss for lack of jurisdiction, you will want to determine (if you can) where the infringer’s business is based.

Client is looking for counsel to potentially handle a federal court infringement suit.  The client is in Massachusetts and the other party is foreign, but apparently residing in the US.

The client runs a "one woman shop", so she’s looking for someone who would be attentive to costs.
