Subject: [E-trademarks] Domicile Issue
I received an Office Action rejecting a domicile address that I'd provided on the grounds that it was just a mailbox, not an actual place of business. In this case, this was incorrect - the OA included a map of the location, but that map was inaccurate, and I filed a response addressing the issue.
However, the bigger issue is that in the Office Action, while the Examining Attorney did not reveal the domicile address in the text of the OA, they did attach several documents related to this building and location as evidence supporting the rejection, revealing the street address and in fact a map of the layout of the office building (which turns out to be inaccurate). So now my client's supposedly secret domicile address is a part of the public record for anyone who wants to dig through the filing.
I don't blame the Examining Attorney - he's just doing what he has to do given these ridiculous rules. But this clearly goes against the USPTO's many statements to the effect that domicile addresses will not be made publicly available, right?
