I interned at the office while I was in law school during the early days of the online filing. All the examiners always groaned when they saw a patent bar # under a signature (I believe it was a free-form entry back then). Apologies to all the patent attorneys on this list – especially Carl, but just because the word trademark is on the certificate, passing the patent bar does not automatically confer trademark knowledge to the patent attorney. Unfortunately, many patent attorney think it does! They, of course, are not on this list serve because if they knew that, they would be!!! So, kudos to all of you who are on this list. And take this from whence it comes – a former science geek/nerd who is patent bar eligible and chose trademark work because it is so much more fun!
I have always thought that the majority of filers were attorneys. For some reason I think I saw a statistic that supported that. At the recent AIPLA Annual meeting, I sought out as many PTO officials as I could find and let them know that they are not catering to their base, namely us, and the new application was too dumbed down. Not a single one of them contradicted me on that point!

It’s been a long time since I examined – I go back to before there was electronic filing – but I seem to recall that approx. 7 of every 10 applications that I pulled were usually filed by an attorney. In those days, it was easy to spot the attorney-filed applications because they were typically accompanied by the letter-formatted transmittal on letterhead. It was not so easy to tell if the attorney was a trademark specialist, though, unless it was a name I kept seeing repeatedly.
Also, I recall seeing a fair number of applications filed by an in-house attorney that looked like it was filed without an attorney because the attorney just listed their name with the contact info for the applicant and not separately as an attorney of record.

If I read your email correctly you are saying that 15% of applications are filed at the USPTO by trademark attorneys? This seems widely inaccurate. I am sure like many on this list when I am analyzing a mark cited as a 2(d) and/or one raised in a search-- I look to see who filed the application etc. as part of my analysis. While this is not a scientific method, I would say that it is more like 85% of applications and registrations I need to look at in more depth are filed by a trademark practitioner. Of course, under current rules ANY application (or maintenance document) filed on behalf of a non-U.S. owner, must be filed by a U.S. attorney. That alone would seem to raise the numbers. What are others seeing in terms of likely percentage of applications filed by IP attorneys?

I asked a trademark examining attorney one time what their estimate was on the number of applications they process that are from experienced trademark attorneys, rather than pro se or the passing lawyer who does applications as part of their general practice. Their estimate was 15%. We are a very small part of the user base and they won't be optimizing for us.

I suspect that this feature is not, in fact, intended for trademark attorneys, but for the 15% of U.S. adults who are smartphone-only internet users - who have a smartphone, but do not have home internet access. This is seen most commonly in adults with an annual income of $30,000 or less.
Seems like it would be nice if they could file a trademark application too, even if they don't have access to a computer, yes?
