[E-trademarks] The 25 Oldest Pending Applications?

Repeating the LD:true AND FD:[* TO 19870113] NOT (SN:8900* RN:*) search today, there's a new addition to the results, namely 73478075, the typed drawing VINTAGE, filed Apr. 30, 1984, yet another application that has been revived by the TTAB after being abandoned over 30 years ago.

Appending  AND SA:ttab to that search, all 25 of the oldest pending applications have the term TTAB in the SA - status field of Trademarks Search, except that SA - status field is not displayed on the summary page.  TSDR shows

An appeal of the examining attorney's final refusal has been received at the Trademark Trial and Appeal Board. For further information, see TTABVUE on the Trademark Trial and Appeal Board web page.

as the status.  TSDR currently does not show any correspondence documents for these revived applications, as they were abandoned long before the USPTO began scanning older applications and other correspondence for load to TSDR.

VINTAGE replaces 73502123 - FULLY-TEMPERED as the third oldest pending application.

Another curiosity: instead of ABANDONED, CANCELLED, or EXPIRED, exporting the search results for this search shows DEAD in the International Class text for these 25 oldest pending trademarks that have been revived by the TTAB.

Unfortunately, I did not include the keyword DEAD in my search strategy to identify live marks without any active GS entries.  Initial tests of that updated search strategy show 124 live trademarks with GS text (in addition to the 2530 live trademarks with no GS text) that have NO ACTIVE CLASSES.  As you probably recall, I only identified 85 live trademarks with GS text having no active classes at the end of August - that the number of trademarks with NO active GS text entries continues to grow.

PS - Hopefully the TTAB is working on the recovery of the initial applications and other correspondence for these 25 oldest pending trademarks for inclusion of the correspondence on TSDR.  ;-}

Revisiting this theme, the search LD:true AND FD:[* TO 19870113] NOT (SN:8900* RN:*) retrieves the 24 oldest pending applications, all in the 73 series, all magically revived by the TTAB, all dead for so long that the TSDR system (admittedly shaky today) shows no correspondence documents for any of these pending applications.  Additionally (by my quick check), none of these 24 pending applications have any active GS entries.

Following is the list in increasing serial number/filing date order. (Congratulations to TEXAN, a new entry to the list, for the status of oldest pending application on Trademark Search.)

PS - Last September, there were only 16 pending applications in the 73 series, so at least 8 other 73-series applications joined the list in the past 11 months.  Of course, the list from last September was generated on TESS, not Trademark Search.

What's the oldest pending application?

Below is my list of pending applications over 40 years old, where the oldest (#17 - SN 73414877) is over 50 years old, although all the 73-series applications (#2-17) are recent additions to the list - recently revived applications thanks to appeals at the TTAB.  The 16 oldest applications had been dead for so long that the old paper files of correspondence were never scanned (i.e., there are no documents for these trademarks on TSDR).

The TTAB appeals revised the live/dead status but did NOT update the active/abandoned/cancelled status of the goods/services statements, so these 16 oldest pending applications are recent additions to my growing list of active trademarks with no active classes (now 46 trademarks).

Other recent additions to my list of live trademarks with no active classes include 98193238 98192947 98189974 98189784 98188611 98188497 98185680 98185562 98185551 98165030, except these applications were added as a consequence of recently revised procedures to load new applications to TESS/TSDR the next day, prior to review/edits by Pre-Exam.
