I note the USPTO has no problem sending renewal reminders to the counsel of record so why do that and not forward a cancellation action?

Apart from being ridiculous, doesn't this somewhat contradict the USPTO's own mantra that the USPTO will not directly communicate with represented applicants and that any communications to a represented client purporting to be from the USPTO are fraudulent?
We know that after registration, the USPTO no longer considers the applicant as being "represented" to reduce conflicts for firms that handle a large volume of renewals. However, the average applicant does not have the same expectation, especially if that applicant has many active applications and registrations. Such an applicant expects that all legitimate USPTO correspondence will be sent to the attorney!

I agree. I guess the days of the attorney providing a courtesy copy to the attorney of record are over, but I have always done so. It’s a ridiculous rule.

You’d think they could at least copy the attorney of record listed for the registration. There will likely be many instances of defaults in cancellation actions because of this rule.

Yes the MyUSPTO alert system can be used to monitor status of any file, not limited to files that one is connected with.
And for those who are lucky enough to be on IP Badger, it offers easy status monitoring for any file.

When a cancellation is filed, since it is post-registration, the Board does not send to the AOR “on file” because technically that power of attorney ended at the time of registration. Anyone ever have a fairly recent registration cancelled by the USPTO without your knowledge? My client discovered it. A petition for cancellation was filed and my client defaulted and the USPTO cancelled the registration pretty quickly. I checked to see why I did not receive any notice, and discovered the USPTO record says “Attorney of Record – NONE” which is very strange. I have always been the attorney of record from application through registration, when the Certificate was sent to me. <http://www.slwip.com/>
