[E-trademarks] Petition to make special

Just chiming in with my 2 cents, but I agree with Mary, here. On the face
of it, only the owner, mark, and goods & services need to be the same.
There's nothing here about register or filing basis or the like. Of
course, I've never had to deal with this situation myself, so the PTO might
disagree! That said, the rules as written don't seem to exclude a new 2(f)
claim.
On the other hand, something occurs to me. It seems worthwhile to point
out that the 2(f) applicaiton is indeed a new application that is
technically unconnected to the Supplemental registration. And, what's
more, it's
an application that gets routinely filed when the Supplemental registration
is up for renewal (as we discussed on this list not too long ago). The PTO
might be hesitant to allow this kind of loop-hope procedure to allow the
2(f) claim to jump to the front of the line, when markholders who file
things "properly" (if you will) do not get such benefits. That is, if I
file the 2(f) application normally when the Supplemental registration has
been live for 5 years, then I have to wait the 7 or 8 months or whatever
like everyone else before the examiner gets to it. But if, oops, I just
let the Supplemental registration lapse, then I get to cut to the head of
the line with a request to make special. And maybe that's not such a good
policy. (Although perhaps a better policy would be making ownership 5-year
Supplemental registration *its own separate ground* for a request to make
special. But I don't control the Trademark Office at present.)
