And keep in mind that you MUST file the extension of time request BEFORE you file a request for reconsideration; you cannot do so afterwards if you are running up on the three month limit and the examiner hasn’t responded.

Yes, it is possible to file for an EOT to file a Request for Reconsideration after a final refusal.  However, if you file a Request for Reconsideration by the initial deadline or by an extended deadline, a Notice of Appeal should be filed concurrently. This is standard form paragraph information provided in the final refusal OA.

Is it possible to file for a 3 month extension of time after a Final Office Action issues? What if I respond to the Final Office Action seeking reconsideration and it is denied?  Can I still file for an extension before the time to appeal runs out?  Thanks for your input.
