[E-trademarks] PostReg OA Rescinding Acceptance of Section 71 Affidavit?

I haven’t encountered this before, but I have filed a Section 8 within the statutory period and gotten an office action after the period ran out.  I think you are stuck with the fee unless you successfully argue that the office action is incorrect (so, e.g., the specimen they are now refusing was in fact proper).

I recently had a PostReg Office Action issue 9 months after a Notice of Acceptance issued. The OA states that the acceptance was issued in error and is now rescinded. Of course, since we are now well beyond the statutory filing period, the PTO is requiring a deficiency fee.

Has anyone encountered this situation?
