[E-trademarks] sanity check

Hi all,

We are getting ready to file a Madrid designating a lot of places our from a US registration, so a big filing fee, so we want to get it right.

My paralegal refuses to believe that a US company can be a "national" --she insists that is only for people so she wants to check the "real and effective presence" box, but I disagree b/c that, IMHO, is for foreign companies who have a factory here or whatever. I cannot find anything confirming that for purposes of filing a Madrid application, a company is a US national so I cannot prove this to my paralegal. Or should we check the US domicile box?

This seems like a dumb question but I'm stumped. I normally avoid Madrid so I'm not too fluent in it.

regards

Janet
