Dale,

I do not think class 45 for licensing intellectual property works.  Actually, you must be licensing the tag line for the specific goods and services that the mark would be used.  You should carefully think this through.  For example, if the tag line would be used on furniture, the mark should be filed as an intent to use application for furniture.  Your client will then need to think about how the client controls the quality of the goods in some manner.

I have a client who wants to register a tag line as a trademark so he can then license it out to others for use on goods and services of their own choosing.



Has anyone ever had a situation like this?



I’m struggling to think of a class and description that would fit this scenario.



There’s this:



045   Licensing of trademarks



But it seems to me that description would apply if the client is providing a service to its customers in which the client assists the customer in licensing the customer’s trademarks, no?
