Since my 4 March report, the USPTO now states that we are currently examining new applications submitted between: August 15, 2024 - August 29, 2024, so I did revise the end date of time-dependent searches from 28 July 2024 to 14 August 2024,  and I updated the last Madrid application from 79401095 (received on July 25th) to 79402133 (received on August 8th).

For search #6, the problem with the LR (Live Registration) search field has been resolved.

I've added search #13 that identifies 29,699 live trademarks received before August 15th that have the new application awaiting assignment to an examining attorney status on TSDR.  The search 1 AND 13 retrieves all 585 trademarks retrieved by search #1 - that all 585 Madrid applications received prior to August 15th that have yet to be processed by Pre-Exam (by the UNKNOWN mark drawing code) have the new application awaiting assignment to an examining attorney status on TSDR.  Coincidence, or does the UNKNOWN mark drawing code prevent these 585 older Madrid applications from being assigned to EAs for examination?  Another curiosity for search #13 is that the highest serial number for that search is 99012680, a 99-series application received in February that petitioned to have the filing date changed to 7 May 2024.  While that petition was granted, the application still has not received the initial processing by Pre-Exam (the UNKNOWN mark drawing code) and awaits an examining attorney.  The relevant status text from TSDR for 99012680 follows.

I see only a few changes among the 11 QC searches performed Tuesday.  Today, I'm adding a new QC search (search #12 on my next full list), namely

Given the large number of trademarks retrieved by this new QC search, here's an alternate search for the purposes of documenting a few examples of some problems identified by the search.

I suspect there may be some false hits among the 153 trademarks for the full list of unusual character sequences.

There is some good news.  So far, this new QC search does not retrieve any 99-series applications filed via the Trademark Center system.

The USPTO now states that we are currently examining new applications submitted between: July 29, 2024 - August 12, 2024, so I did revise the end date of time-dependent searches from 21 July 2024 to 28 July 2024,  and I updated the last Madrid application from 79400320 (received on July 18th) to 79401095 (received on July 25th).  Curiously, those changes increased the number of problem trademarks for the first 4 searches.

There was significant progress for search #8.  Curiously, searches #5 and #8 share 3 trademarks that refuse to die.  Irregularities for search #10 are completely resolved.  I'm still vexed that the USPTO is not inclined to address the older applications with the UNKNOWN mark drawing code (searches #1 and #2).  By my checks, the first 4 searches retrieve 600 trademarks, where 592 still have NOT been assigned to EAs for examination.  Of the 8 currently under examination, 4 do NOT have GS text on TM Search (98660068 98337844 97978301 97874126).

Reviewing the 6 corrections performed for search #7, I take objection to at least one correction, namely 90661045 - µPLS.

The Jul. 29, 2021 Design Search Code Corr Project document shows µPLS (Stylized/Design) in the header with the following design codes.

26.09.02 - Plain single line squares

The Dec. 17, 2021 TRAM Snapshot of App at Pub for Oppostn shows µPLS as the literal element.

The Jul. 11, 2023 Section 7 Request shows µPLS as the literal element.

But the May 13, 2024 PostReg Office Action - No Response Required document shows ?PLS as the literal element.

What happened between the Jul. 11, 2023 Section 7 Request and the May 13, 2024 PostReg Office Action? We'll probably never know.

Today, the unexpected ? (question mark) in the literal element has been corrected.  Today, both TM Search and TSDR show PLS as the literal element. The search CM:*µ* AND SN:90661045 fails to retrieve this registration.  Apparently, whoever performed the correction did not consider the standard character µ to be significant.
