[E-trademarks] Avoiding the "Broken Lightbulb" Issue with Trademark Center?

Hi All,

I just had the broken lightbulb issue come up yesterday.  The person who originally created the signature link for the application (which I then sent to the client) was able to “Share” the application, via the “My drafts” tab in the “Drafts and docket” section in trademark center, with me after the client signed.  When I then chose to “edit” the application from my docket in trademark center, I could submit the application that included the client’s signature.  So, adding steps 6 and 7 below seem to be a current, if partial, workaround:

  1.

Attorney 1 instructs and paralegal 1 prepares new TM app.  The new TM app is prepared by the paralegal when logged into their USPTO account

  2.

Link to application sent to client to sign

  3.

Client signs application, link returns to firm

  4.

A different individual than paralegal 1 (say, paralegal 2) tries to hit the file application button on the email.

  5.

Broken lightbulb error message

6.

Paralegal 1 “Shares” TM app from TM center with Paralegal 2 who will file the application

7.

Paralegal 2 accesses TM app in Drafts and docket section, sees client signature already present, and files and pays for the application.

This still requires Paralegal 1 to be involved after signature, so certainly not ideal.

I haven’t tried asking Paralegal 1 to share the TM app after the link is created but prior to client signature (e.g., can step 6 be conducted prior to step 3?).  If that happens to work, at least it could be done at the time the link is created so Paralegal 1 isn’t required after client signature.

Hello All,

Apologies if this has been discussed in the past, but has anyone come up with a good strategy/practice for issues that come up now with new applications filed through Trademark Center?  The scenario that keeps coming up in our firm is this:

  1.

Attorney 1 instructs and paralegal 1 prepares new TM app.  The new TM app is prepared by the paralegal when logged into their USPTO account

  2.

Link to application sent to client to sign

  3.

Client signs application, link returns to firm

  4.

A different individual than paralegal 1 (say, paralegal 2) tries to hit the file application button on the email.

  5.

Broken lightbulb error message

To the best of my knowledge, paralegal 1, attorney 1, and paralegal 2's USPTO accounts are all connected and sponsored.

It seems that only the individual that originally prepared the application can actually complete the filing through their account. Which I suppose makes sense.  But I am wondering how firms are handling this, if say the paralegal that prepared the app is out of the office when the link comes back signed?  Is there a solution here that I am missing to avoid the broken lightbulb?  Thanks!

Wouldn't it have been nice if the Trademark Center developers had engaged in meaningful dialog with the membership of this listserv back when they were designing Trademark Center.  This is a feature that we all need.

Applicant for trademark is an LLC. Signatory A is a Member of the LLC and is therefore authorized under the TMEP to sign the trademark application for the LLC.

Signatory A is now unavailable, but has executed a Power of Attorney under state law authorizing B to sign documents on her behalf.

Can B sign the TM application on behalf of A? Most TMEP sections talk about who is authorized to sign for the Applicant, not the signatory.

Section 611.04 deals with who is authorized to sign for the Applicant.  This situation is different. I cannot locate a TMEP section on it.

If we go this route, does signature line say: Jane Doe, by John Doe as her Attorney in Fact Anybody dealt with this situation before? I plan to call the TAC in the morning but thought I would check with the brain trust. Thanks

As I understand it, the requirements for signing the initial trademark application are substantially lower than the TMEP 611.04 requirements for who can sign a response on behalf of the applicant. Per TMEP 611.03(a), as long as Signatory B has "firsthand knowledge of the facts and actual or implied authority to act on behalf of the owner", she can sign the application. I don't believe she could properly sign a response.

Hi all,

We've inherited an application filed pro se by  a client that is a corporation, but who listed themselves as a "limited company" on their app. The examiner issued an OA requiring us to clarify the legal entity in the application by either (1) specifying the entity type that would be the equivalent of a “limited company” in the US or (2) providing a description of the nature of the foreign entity that is applying. No mention of correcting the entity type to another entity.

I've scoured TMEP and can't figure out if we can simply amend the entity type to "corporation" as our response to the OA. Section 803.03 and 1201.02(c) suggest that's acceptable (though 1201.02 is primarily concerned with corrections to the name), but since there are specific requirements for how an application in the name of a corporation has to be signed, I'm afraid of inadvertently voiding the application by doing so. It's also not clear if we're required to provide an explanation. Section 803.03 addresses when the examiner must request  one, but that's it.

I also realize that the easiest way to find out would be to call the examiner, but we're not AOR on the application yet and, for a variety of reasons, we'd prefer to handle that appointment as part of the OA response if we can.

I know I'm probably WAY overthinking this, but would appreciate it if anyone has any insight into whether a simple amendment to the entity type is an acceptable response.

I've had a pro se client choose the wrong entity and was able to correct it through a voluntary amendment.  You have to state that it was a mistake, that the entity is and always was a corporation, and that there never was a limited company.  Otherwise, if you merely change the entity type, they will ask you for evidence of an assignment.

Applicant for trademark is an LLC. Signatory A is a Member of the LLC and is therefore authorized under the TMEP to sign the trademark application for the LLC.

Signatory A is now unavailable, but has executed a Power of Attorney under state law authorizing B to sign documents on her behalf.

Can B sign the TM application on behalf of A? Most TMEP sections talk about who is authorized to sign for the Applicant, not the signatory.

Section 611.04 deals with who is authorized to sign for the Applicant.  This situation is different. I cannot locate a TMEP section on it.

If we go this route, does signature line say: Jane Doe, by John Doe as her Attorney in Fact Anybody dealt with this situation before? I plan to call the TAC in the morning but thought I would check with the brain trust. Thanks
