And if they do know about it, and know their name is being used, there still isn't much they can do to stop it. The scammers running this using my name didn't slow down when I contacted them and told them to stop using my name.

Not merely malpractice, but certainly an ethical violation as well, and maybe a crime.  But I doubt it’s a real attorney (or if the person is real, that they know their name is being used).  And this scam seems to have replaced the Chinese domain name scam that followed these same lines.  At least with that scam, they weren’t making representations about your right to use your own name except for the domain in question.
