Subject: Re: [Patentcenter] Assignment against a PCT other than RO/US?

By the way this posting which is about Ass. Center does not belong in the Patent Center listserv. The Patent Center listserv is only for defects in Patent Center. This posting belongs in the Patent Practice listserv.

The only ones that might successfully get through Ass. Center are the ones where US national phase has already been entered and, I'd guess, the official Filing Receipt already mailed out, showing the continuity data back to the PCT.

This is a known defect, see https://blog.oppedahl.com/some-of-the-defects-in-the-new-assignment-center/ .

I predicted this defect back on January 29. See https://blog.oppedahl.com/wp-content/uploads/2024/02/20240129-prediction.pdf .

I just got off the phone with the assignment branch. I am trying to record an assignment against a PCT filed in RO/CN and Assignment Center will not accept the application number. The PCT is published and is readily available in Patentscope.

The person on the phone instructed me to email a screen shot showing the PCT number and the error message so they could determine why the system will not accept it. I asked her why the PTO needs the application number and error message if Assignment Center will not accept PCTs that are filed in other than RO/US. She said the system does accept SOME PCTs from outside the US and that is why they need to investigate the specific numbers that their system does not accept.

I asked her what I can do to record an assignment against my CN PCT while they investigate the issue in the Assignment Center. She said there’s nothing I can do. I asked if I can fax the assignment in to be recorded and she that won’t work because she said that when an assignment is faxed into the office, they manually put it through the SAME Assignment Center system that we use on-line. She said there is no other way for the PTO to record an assignment.

Is it true that the new system is rejecting only SOME of the PCTs filed outside RO/US? Have any of you successfully used Assignment Center to record an assignment against a PCT filed in a receiving office other than the US?

For the record, the assignment system returned this message:
