Thank you, Carl – that’s what I’ve suspected and I wish they’d do away with that option altogether. So as long as it doesn’t matter what I select, looks like either “organization” or “corporation” is an option!

Best regards,

Katherine

Subject: Re: [Patentcenter] Online issue fee transmittal

Not that it answers your question really, but for some application types (among them, a 35-series application) it is impossible to use the Patent Center online Form 85B and the only way to pay is an old-style PDF form. And on the old-style PDF form, I no longer bother to check any of the boxes for the entity type. It's years since I checked any of the boxes. And not even once has the USPTO bounced the payment for failure to check any of the boxes.

My main point being that I think the USPTO absolutely does not care and does not pay any attention to this information. Note that the form itself states that the entity type information that you provide will not be printed on the front page of the patent.

Some years ago I looked and looked and was unable to find any authority in 35 USC or in 37 CFR actually requiring the filer to provide this information. Nor was I able to find anyplace in MPEP that would purport to require the filer to provide this information.
