Is the PTO aware of the President’s campaign against “junk fees”?
20 years ago, when I was a member of the PPAC, I proposed privatizing the PTO. It got a few laughs, a few blank stares, and one near explosion of the POPA president’s head. Maybe it’s time to reconsider.

Often times an Applicant is lucky if they can get an allowance within 5 years of filing.
So, the USPTO can drag their feet on examination and if a client wishes to file a continuation or divisional after allowance of even a first filed application, they will now have to pay a hefty penalty.

I suppose one consequence of this particular gouge will be that when somebody gets an N-way restriction requirement, they will be incentivized to file the N-1 divisionals right away rather than foot-dragging the divisionals.

I call bullsh*t on their assertion that the proposed fee will off-set foregone maintenance fee revenue… If a continuing application has a shorter patent term such that the 11.5 yr MF doesn’t apply, then the USPTO doesn’t have to expend the time and effort to “maintain” the patent. Besides each fee is to recoup the costs for the given thing. Thus, e.g., the application filing fee is to cover the costs of intaking/processing the new application, examination fees to cover the costs for examination, … etc. and maintenance fees are to cover the costs of post-grant maintenance.
This and some other proposed fees look like another money grab by the USPTO so they can dole out money for, e.g., NASCAR sponsorships.
