David - what is your non-conforming DOCX? [I would think its a non-text DOCX - i.e. your AUX pdf file which each page converted into a GIF file and embedded into DOCX, page by page - is this correct?]How is it safer than an 'ordinary' DOCX?Does your non-confirming DOCX avoid the $400 surcharge?

That's more or less what I do. The word processor I use generates only a DOCX that doesn't conform to the regs. So I file the non-conforming DOCX with the auxiliary PDF. I get a request for substitute spec, and I then file my "auxiliary PDF" as a substitute spec. Voila, no fee, no hassle.

An alternative is to use pdf-xchange to convert the document to docx, and to include the backup pdf upon filing. Since the parent case is incorporated by reference, I can then just file a replacement spec later, viz. the original pdf (rather than proofread the "docx" version, which isn't worth my time or the client's money).
