[E-trademarks] It's not enough the scammers are trying to scam our clients, now they are maligning us too

Yep, you can add defamation to the list of torts they’ve committed.  Finding the individual scammers, of course, remains a big problem in holding them accountable.

Is telling lies and then saying their current attorney is bad and should be reported to the BBB not a form of slander? It sure sounds like it to me!

Today I saw a nasty new one from Trademark Formation: a text to a client with what was almost certainly a photoshopped TSDR image of what looked like an infringing new application.
It purported to be filed yesterday, with serial number starting with 99 - of course not found on TSDR.    (Yes, I’ll check again tomorrow, but still beyond highly dubious.)

Just another warning to add to your list when frightened clients reach out.

“The Trademark Formation email went on claim that the attorney had “mishandled” the trademark application, and even urged the recipient to “report” them to the Better Business Bureau (BBB). “We have been in this business for over 10 years and have always maintained our credibility,” the email claimed. “It’s not in our interest to risk that for a small fee.”
The email then requested a $600 fee to amend the application, with an offer to “arrange a payment plan or negotiate a further discount”.
When the recipient did not immediately respond, Trademark Formation reached out by phone again. “They further claimed that ‘my IP attorney’ had filed my application ‘wrong’, and offered to represent me and give permission to abandon [the attorney] and sign on with them,” they explain. “They claimed to be personal friends with the examining attorney who was on my case at the USPTO, and [said that they] could address and fix the issue ‘today’ and guarantee that my trademark application would be secure and move forward.”
“They also told me that currently my application was ‘rejected’ and that the other party would be awarded my trademark name if I didn’t act immediately,” they added.”
