Heather – I always advise clients to file directly in China due to the subclass system.  Madrid extensions are generally very narrowly construed by the China trademark office and, as a result, often do not cover the range of subclasses that would be important to the client.  You can avoid that problem with national applications and guidance from local counsel.

What is the current collective wisdom on dealing with counterfeits coming out of China?  Is registration worth it?  Better to use the Madrid Protocol or hire a local attorney for a national registration?
