[E-trademarks] Acceptable use for "real estate development"

Hi listfriends:

I hope this finds you having a wonderful Wednesday.

A totally fictitious client wants to file an In Use SM reg app for real
estate development and construction services.  They have gathered
partners, made site surveys, REID analysis, financial modeling, and site
review (civil engineering), but have yet to craft the construction plans or
break ground on the property they are developing.

1. Please confirm my hunch that the above-described work constitutes "real
estate development services," and that ground need not be broken for there
to be "use" of the mark for such services.

2. Please confirm my hunch that ground must be broken & a building must be
in the process of being built for there to be "construction services."
