Yes. Take a look at TMEP 1714.01(b). If you want to file a statement of use, you have to pay both the extension fee AND the SOU fee. Note that you can’t use the petition to revive if you are out of extension requests, because the 3-year period to file the SOU after the notice of allowance is statutory.

Dear List Mates,
How easy is it to revive a 1(b) application for failure to file a statement of use? Is it pretty automatic, or is there something that needs to be shown beyond the statement that abandonment was inadvertent? I don't think that I've never had to do this for someone before.
