I agree since the system can be programmed to allow a party to choose whether they want the new system forms or the old system forms.  Also the new system can be programmed to use the old forms format.  I was told they could not keep the old system going but there is no reason the formats used in the old system cannot be implemented into the system.  I know that as I was a forms designer for computer systems prior to going to law school. Annette

Okay, I take it all back. The drafts don’t seem to be available anymore once you log off. Stay away from Beta. I gotta go re-do an application from scratch now.

Just bouncing on to this thread to say that I (accidentally) tried the beta system today. The save draft at the bottom of the screen as you go through the application is actually nice, as well as the ability to import your contact information from MYUSPTO. The frustrating parts I see so far is that there seems to be only one Address line, so the firm name and the address have to on the same line, and also if you make a typo in the first use date as I did, you apparently have to exit out and go back to the draft before you can fix it. Other than that, I agree with everyone who said that this is clearly set up for non-represented applicants and there is too much noise for experienced filers, but there are certainly a few benefits such as importing the address that it would be nice to see added into the legacy system.

Just tried out the new beta system. As a paralegal, it is atrocious in my opinion. First of all, it does appear to cater to novice filers which is totally counter to the requirement that all applications be handled by US attorneys. IT requires you to manually go through multiple screens and opt out of extra statements instead of just allowing you to opt in to extra stuff if you might need (translations, geographic significance, disclaimers, etc). It is not easy to tab through and add prefilled information from your browser's memory like it does currently.

In the attorney's section if you try to import the data of the account to save some labor and you are a paralegal, it will fill in the paralegal's information so that feature is basically useless for anybody other than attorneys preparing trademark applications. I don't see that you can copy drafts and replicate for a new filing like you can in the assignment center so there does not appear to be ways to set up templates to avoid having to fill in repetitive information.

The worst part in my opinion is the section where you select TEAS PLUS ID of goods/services it basically has the options in a tiny scrolling screen with 10 or so options and makes you click next to find your selection instead of being to browse a large selection of options and click checkboxes for the applicable ones.

Not having the obj. file save option is also unforgiveable given that it appears the links will only be valid for 60 days.

Any USPTO lurkers here, please do not force us to use Beta. The current TEAS system layout and functionality is far superior to this system. There are a few things that would actually improve our experience such as being able to set up templates for frequent clients and have it auto-fill in the attorney information and all of these things I think could be implemented easily without having to revamp the entire platform. None of these improvements were included, and the functionality is vastly worse.

Also, as an active Patent Center user I can attest to what a disaster it has been and don't have high hopes for this Beta system getting any better. I really hope this system doesn't replace the old one anytime soon.

Paul—

Do you know if the drafts of people you “sponsor”  (i.e., your staff) are also available at your account?  If so—sounds like an improvement.  If not, sounds even less useful?

Actually, the lack of being able to save an .obj file is not an issue with the Trademark Center Beta.  If you go to the Trademark Center home page, there are 4 tabs at the top.  The third tab is “Drafts and docket” where you can find your applications where you left off.  Frankly, it is a lot easier than saving a download of the .obj file (and remembering always to do so) and then trying to find the downloaded .obj file you saved.

That is correct, at least how we tested it. They did have our attorney and law firm information saved for easy reproduction in a new application and I thought they might be permitting templates to be set up but I didn’t experience that with the beta test.

Actually, when I first got into the beta test, the form was limited to just preparing an ITU TEAS+ equivalent (needing to use ID Manual IDs). They expanded the application options later on to include 1a and Section 44 applications but, like Miriam, I was already frustrated with the slowness of the application, needing to read through a lot of explanatory material, combined with the inability to save and retrieve a draft application so I never tested the more capable forms.

I did a 1:1 telephone focus group call with the later version of the form and that allowed the explanatory material to be hidden but the form was still spread out across a lot of screens. The print was very large too so I guess it could be targeted to more senior people. I’m not recalling other aspects of the process that stood out to me.

Do you mean there’s no option to save an .obj file? If so, that’s a huge oversight and massive inconvenience.

EXTERNAL EMAIL

I volunteered to be a beta tester of it. As I recall, I was not very impressed with it as a practitioner because the new application form seemed targeted to non-attorneys with too much explanatory material and pretty much only one section per screen. The biggest drawback that stopped me from using it was that there is no option to save the data one inputs and go back to it later or to have a paralegal draft the application and share the draft with me. .

Oh and by the way, maybe I missed it, but I do not recall having seen even a hint or suggestion of the Commissioner asking the membership of our listserv what, if anything, we think is broken in TEAS that needs to be fixed in this new TC, nor do I recall having seen even a hint or suggestion of the Commissioner asking the membership of our listserv what new features, if any, we wished to see added in this new TC.

See https://blog.oppedahl.com/commissioner-for-trademarks-responds-to-the-fifty-four-trademark-practitioners/ in which Fifty-Four Trademark Practitioners wrote to Commissioner Gooder on August 7, 2021 asking for some improvements in TEAS, particularly in the area of character-count limitations in various fields.  In October of 2021, Commissioner Gooder promised that we would get all of our "asks" from that letter.  When the beta version gets released, I am confident it will turn out that Commissioner Gooder will have kept that promise.

We’ve been working on Trademark Center, a new system designed to improve your filing experience. This summer, you’ll be able to use the beta version of Trademark Center to apply to register your trademark.

You’ll have the option to apply to register your trademark in either Trademark Center or the Trademark Electronic Application System (TEAS) for six months. The cost to file remains the same in both systems.

Given the disasters of Patent Center and Assignment Center, I feel that I can predict with very high confidence that this new "Trademark Center" will likewise be a disaster.
