[E-trademarks] use in commerce question

I haven’t come across that exact situation before, but I think the plain language of the Lanham Act’s definition of “used in commerce” supports your position.

Client ships working prototype of machine bearing trademark to foreign trade show and to do so has to obtain a U.S. export license b/c of sensitive technology.

I plan to take the view that this is use in commerce, b/c Congress regulated the permission to export the device.

Anyone come across this?
