Here’s the scenario:

Client is unable to show commercial use for a registration renewal of an application filed under Section 44(e). The client will be able to show commercial use shortly after the trademark registration will expire. As such, the plan is to file a new application for the same trademark once we can show commercial use.

Question: Is it acceptable to reference again the same 44(e) in the new filing?
