More TM weirdness going on at the PTO.  On Friday, I got a notice of acceptance of statement of use for an application.  Trouble is, I had already gotten a notice of acceptance of the statement of use back at the beginning of April.  No intervening action by the PTO to withdraw the first acceptance.  I’ve seen them send out various duplicate emails before, but usually not 6 weeks apart.

That’s not the only oddity with the file.  First, the prosecution history doesn’t actually show the latest acceptance notice.  Second, this notice has a different name in the document description field—“Notice of Acceptance of SOU – E” instead of “Notice of Acceptance of Statement of Use.”   The April SOU acceptance is also accompanied in the file by a copy of the TRAM Snapshot of the mark at publication—from well over a year before.

I do hope that this time the application will actually move forward to registration.
