As I read the rule, the application surcharges only apply to applications filed on or after 18 January 2025. The rule is written to replace the existing application system consisting of the TEAS-Standard and TEAS-Plus applications along with their associated fees with a single base application with certain requirements and surcharges for failing to meet those various requirements. Because the base application and surcharges are a collective package, their associated fees will go into effect together on 18 January 2025 and will not apply to outstanding applications filed before that date.

To answer your specific questions:

  1.  No, any application filed before 18 January 2025 will not be subject to the new surcharges.
  2.  Yes.
  3.  Not necessarily, but they should ensure that the scope of the foreign-registration identification is written broadly enough to include the goods and services found in the ID Manual that they want to include.

Alternatively, an eligible foreign applicant could use the Madrid Protocol to request extension of protection to the United States. Starting 18 January 2025, the Madrid application fee is $600, but it is not subject to the new surcharges. This would save $50 to $250 per class for non-standard identifications.

Not sure if I missed something in reviewing all the discussion in the Federal Register Notice, but other than the exceptions to certain changes for Madrid/Section 66 applications, I have not seen whether currently pending (filed prior to January 18, 2025) Section 1 and Section 44 applications, especially those which have not yet been examined as of January 18, can be dinged with the various new surcharges/fees.

  *   Do we have to start preparing new applications with the surcharges in mind knowing they won't be examined before January 18?

  *   If a foreign associate wants one of us to file a new Section 44(d) application with lengthy lists of goods/services which likely exceed the 1,000 character limit and/or are not selected from the ID manual, should we be counseling them to file the U.S. application before January 18?

  *   Should we be counseling our foreign associates with clients planning to file Section 44 applications in the U.S. to use the US ID manual when crafting the goods/services in the underlying foreign applications?

Or, am I simply overthinking this?
