I feel professionally obligated to remind anyone who might be interested that if you don't like what's in the ID Manual it's often possible to change it. If you have particular language you'd like to suggest you can email it to: TMIDSUGGEST at uspto.gov https://www.uspto.gov/trademarks/guides-and-manuals/trademark-identification-goods-and-services-manual-suggestions Sincerely, Ed Timberlake  Board Certified Specialist in Trademark Law Timberlake LawChapel Hill, NC Schedule a call on Clarityed at timberlakelaw.com919.960.1950

Many of the manual ids are so specific and not applicable to one use.  The manual needs a major overhaul since it seems to be a compilation of ids used in prior applications and not at flexible.

Yes, they stick to the ID manual. In fact, given these trends, we can expect that those terms may become mandatory, whether by policy or practice.

Over the past year, I have gotten the feeling that because of the “newness” of so many examiners, they are sticking to the rules and acting like there is no room for discussion – it’s like someone put the fear of god into them if they diverge even an inch!

Best,

Subject: [E-trademarks] Examiner refusing to discuss revised ID!

I think this is the fist time this has happened to me.

I got a pretty dumb ID refusal from an Examiner. I responded, and he went final on me.

His refusal is still pretty dumb,  but I sent him an email with a proposed revision for us to discuss.

He refuses to discuss and wants me to file my official response. I said it was customary and he said it's not required.

Are they on some kind of work-to-rule strike?

I escalated to the Managing Attorneys for help. It is ridiculous to make me file an appeal brief on an ID issue where I still don't know what he wants.

Grrr.

thanks
