If it is an individual, I check “national.” If the applicant is a business, I check “real and effective commercial establishment.” We’ve never had an issue.

My paralegal refuses to believe that a US company can be a "national" --she insists that is only for people so she wants to check the "real and effective presence" box, but I disagree b/c that, IMHO, is for foreign companies who have a factory here or whatever. I cannot find anything confirming that for purposes of filing a Madrid application, a company is a US national so I cannot prove this to my paralegal. Or should we check the US domicile box?
This seems like a dumb question but I'm stumped. I normally avoid Madrid so I'm not too fluent in it.
