[E-trademarks] Law firm/not law firm?

Certainly possible...but if you’re an attorney why would you risk inadvertently giving legal advice about a legal proceeding or legal matter? Why not just “wear the lawyer hat” for trademark preparation and response services? I’m sure the malpractice provider would like to know that, if nothing else...

Is it possible that the firm does other non-legal work and she is trying to (in-artfully) make sure that, as to that work, she is not considered to be "wearing her lawyer hat" and acting as a lawyer in connection with that other work?
