[E-trademarks] Domicile address provided by registration service

We’ve been tracking a pending application (not our client’s application) where the applicant used the 30 N Gould Street address in Sheridan, Wyoming. The examiner in that application raised a series of objections (primarily Section 2(d)), but also rejected the applicant’s address as not a valid domicile address. The examiner argued:

Domicile address cannot be accepted.  Applicant must provide its current domicile street address because the domicile address of record is for a U.S. third-party registered agent (a private business that accepts service of process on behalf of third parties), which is not an acceptable type of domicile address for a juristic applicant.  That is, this address does not identify applicant’s principal place of business.  See 37 C.F.R. §§2.2(o)-(p), 2.11(b), 2.189; TMEP §601.01(b)(1).  All applications must include an applicant’s domicile address.  See 37 C.F.R. §§2.32(a)(2), 2.189.  Please see the attached evidence showing that applicant's address (30 N Gould St., Sheridan, WY, 82801) is a registered agent address.

The examiner then included a Google maps photo of the address which is for Wyoming Corporate Office LLC.

In the case of the application we’re tracking, the applicant does not appear to have responded to the office action.

My client tells me the LLC registration service it uses provided a "real" address:

    30 N Gould Street
    Suite [omitted here]
    Sheridan, WY 82801

There appears to be a bunch of registrations by owners organized in Wyoming, and using the same address, based on my somewhat crude search: OW:30 AND OW:gould AND OW:wyoming AND LD:true but perhaps they were lucky, or predate the current policy on review of Domicile addresses.

In the worst case, my client could see what happens - and if flagged, decide how to respond then.

Suggestions?
