[E-trademarks] On Veuve being an obscure word - E-trademarks Digest, Vol 22, Issue 10

I'm a native French speaker and learned English early. On veuve being an obscure word, I'd say it isn't more obscure than widow would be in English. In both languages, widow/veuve is a word that we learn later in life compared to vetements/clothing, which we need to know as a child. When we're old enough to understand death, and hear stories and watch movies, we learn what veuve/widow means.

I took French for twelve years, and vetements would immediately mean
"clothing" to me. ( I like Maria E  don't agree with the stop and translate
theory for foreign equivalents  - If you know the language, the meaning is
immediate) Like LA DOLCE VITA

I also know the word veuve but would not have immediately translated that
for champagne or wine because it doesn't seem to have a
descriptive significance for the goods. I will be interested to see how
SCOTUS resolves the circuit split on this doctrine.

There's a new beta feature on Trademark Search.  Here's a snapshot of the notification on top of the search screen.

It basically provides an alternative full record view of the trademark.

See more information when you open a search result
As part of our fall 2025 release, you can try our new beta feature, which shows more information about a trademark when you open a search result without needing to go to the Trademark Status and Documents (TSDR) system.
To use this new feature:

  1.  Complete a trademark search.
  2.  At the top of the results page, toggle the new feature opt-in to the “On” position.
  3.  Select a search result.
  4.  The details page will now show most of the information from TSDR without having to leave the search system.

If you’re logged in to your USPTO.gov account, you can choose what information to include on a summary page.

  1.  Use the toggles in the trademark details to choose which sections to show in your summary.
  2.  Select the drop-down arrow next to the Print/Save button and select Case summary.
  3.  This will open a case summary with the information you chose to see. Select Print/Save to print your summary.

If you’re logged in, you can also view the file in TSDR by selecting the View details button from the case summary page.
To stop using the new search feature, return to the results page and toggle the button to the “Off” position.
If you have comments or suggestions about this new feature, use the feedback button in the search system.

Wait … are you saying that the USPTO's OG review process should include searches that show contradictions for the standard characters claim?   Like for this DIMIQI example, a search like

MD:standard AND DE:( RED STYLIZED SUPERSCRIPT ) AND PO:*

would have alerted the OG reviewers to check this particular DIMIQI application before the 30 September OG was issued?  Is that (in part) how Ken finds some of these challenging standard character marks, namely that Ken searches for terms like stylized or red or superscript occurring in the description of mark field of standard character marks for trademarks having the approved for publication status?

Well, that's pretty simple.

I'll bet that Ken is still collecting contradictory searches like that to help identify some of these challenging standard character marks.

The strange part, though, is that by my review of the raw application for this DIMIQI mark, there is no trace of a claim to standard characters.  There are just 3 documents on TSDR, namely

Aug. 29, 2025     TRAM Snapshot of App at Pub for Oppostn
Aug. 29, 2025     XSearch Search Summary
Apr. 01, 2025     Application

where only the application is from the applicant. So how did this become a standard character mark?  The description of mark The mark consists of the stylized wording "DIMIQI"  is included in the application.  Do you suppose Pre-Exam decided that this DIMIQI mark was a valid standard character mark?  Or did the EA make that change without including an examiner's amendment?  I guess we'll never know.

retrieves those 86 older standard character mark registrations, but I'm not energetic enough to generate a report with the drawings and my comments on why the standard character claim is challenging.  For most, a quick glance at the drawing is sufficient to see the standard character claim is inappropriate, but these are now active registrations, so I doubt the USPTO will do anything to try to correct the standard character claims, right?  That's why there's a TTAB, right?

Yes, we look in TSDR and we see that the Trademark Office clerks have indexed this application two ways.  First, the description of the mark:

Description of Mark:    The mark consists of the stylized wording "DIMIQI".

Okay, so it is stylized.  That's settled.  But wait!  We also see these words in the TSDR record:

Standard Character Claim:    Yes. The mark consists of standard characters without claim to any particular font style, size, or color.
Mark Drawing Type:    4 - STANDARD CHARACTER MARK

Seems to me they can't have it both ways.  Well, somebody was wrong at the Trademark Office.  Look at this and decide for yourself who was wrong:

Oh and note that "review prior to publication" is completed!  The nameless Trademark Office people who do this review seem to act on a hair trigger.  But not in this case.  They snoozed through it.

The wide margin option for print/save gave better print results with text appearing in two columns instead of just one.

My first test indicates it is more copy/paste friendly.  Case in point, here's a copy/paste of a partial record directly to my email editor. (It does eat a lot of vertical space, versus putting the text next to the labels.)

I was playing around and did a search for MY that got a very large number of results (over 17K live records).  When I clicked on a mark or the hyperlinked word mark underneath it, it takes me to an entirely different mark in TSDR (but another MY mark that was presumably within the search results).  For example, when I clicked on MYACCESSIBLE HOME (Ser. No. 98552848), it took me to the TSDR record for MY.COM, Ser. No. 77213546.  If I page back and forth in the search results, sometimes it fixes this, other times not.   I’ve never seen anything like it before.  Because the search results show the serial number, you can cut and paste it into TSDR to get around this, but the fact that the result links to an entirely different mark is more than a bit unsettling.

An application is being refused because the examining attorney maintains, on the basis of I know not what, that Applicant’s provided address appears to be that of a virtual office claimed by various businesses, and therefore is not the location of applicant’s headquarters where its senior executives or officers ordinarily direct and control applicant’s activities.

The address, which includes street number and suite number, is that of my client’s law firm, from which she also runs the applicant company. This same address has been the basis for other trademark applications without any such objection.

Of all the objections I’ve received in my more than 40 years of doing this work, this has to be the most asinine. Since when does/can an EA claim that an actual street address isn’t an actual street address? Does someone actually have to go and take a photo of the building to prove that it’s a real address?

More fundamentally, her assumption that it is a "*virtual address"*  and
thus "*n**ot the location of applicant’s headquarters where its senior
executives or officers ordinarily direct and control applicant’s
activities" is unfounded.*

I think the Examiner may be equating shared office premises with virtual
locations.  Many small businesses especially startups actually rent space
in and work out of such offices. I would come back with my client's
affidavit to this effect. It should be hard for her to maintain her refusal
in light of a client statement under oath that directly contradicts her
incorrect factual assumptions.

I had this issue with my SAM registration as well for the firm, and what I
ended up doing is sending a copy of the lease agreement showing the
property we were leasing as well as photos of the list of occupants from
the lobby.

It's dumb, but they do assume that if there are multiple companies shown at
a location it's virtual.

The new feature is interesting, but I already found a problem. I looked up a mark, clicked on it to see the "new" details and in the owner section, the entity type is correctly listed as corporation but the location states "UNITED STATES OF AMERICA" instead of the state in which it is incorporated! TSDR has the info, i.e.  Delaware.

I'm glad this is just beta, but will they hear us????

The wide margin option for print/save gave better print results with text appearing in two columns instead of just one.

My first test indicates it is more copy/paste friendly.  Case in point, here's a copy/paste of a partial record directly to my email editor. (It does eat a lot of vertical space, versus putting the text next to the labels.)

  1.  Use the toggles in the trademark details to choose which sections to show in your summary.
  2.  Select the drop-down arrow next to the Print/Save button and select Case summary.

Trademark search system updates

You'll find a simplified interface and new capabilities to meet your needs.
Your feedback helps us continuously improve the system. If you want to send us your comments and suggestions, use the feedback button on the right side of any page within the search system.
See more information when you open a search result
As part of our fall 2025 release, you can try our new beta feature, which shows more information about a trademark when you open a search result without needing to go to the Trademark Status and Documents (TSDR) system.
To use this new feature:

  1.  Complete a trademark search.
  2.  At the top of the results page, toggle the new feature opt-in to the "On" position.
  3.  Select a search result.
  4.  The details page will now show most of the information from TSDR without having to leave the search system.
If you're logged in to your USPTO.gov account, you can choose what information to include on a summary page.

  1.  Use the toggles in the trademark details to choose which sections to show in your summary.
  2.  Select the drop-down arrow next to the Print/Save button and select Case summary.
  3.  This will open a case summary with the information you chose to see. Select Print/Save to print your summary.
If you're logged in, you can also view the file in TSDR by selecting the View details button from the case summary page.
To stop using the new search feature, return to the results page and toggle the button to the "Off" position.
If you have comments or suggestions about this new feature, use the feedback button in the search system.

You might try the following.

I recently encountered a similar issue and submitted a print-out from the State's corporations' page showing the client's (not Resident Agent) address --

The Examiner accepted the address as the applicant's "domicile" address, and the address questioned by the Examiner was accepted as the applicant's "mailing" address.
