I initiated this thread in December.  After we were unable to file the ePetition, I filed the aia0083, and one month later received a “Notice Regarding Power of Attorney” saying “the power of attorney in this application is not accepted because there is no alternate correspondence address, either in the application file or the request.  Please provide a correspondence address to which further correspondence can be directed.”


Of course, I hadn’t actually filed a power of attorney.  I had filed a “REQUEST FOR WITHDRAWAL AS ATTORNEY OR AGENT AND CHANGE OF CORRESPONDENCE ADDRESS” which is a petition.  And naturally I had provided the applicant’s address for further correspondence.  So the notice made no sense.

I called the Office of Data Management, and the explanation was that the applicant address I had put down was not the address on the ADS (the applicant had moved.)  So in order to withdraw as Attorney of Agent of Record, we would need to file a corrected ADS and obtain a corrected filing receipt.  So we would need to spend even more unremunerated time to file a petition to withdraw from a case which we are withdrawing from because the client lacks the funds to continue.

As you know, when one previously withdrew using the ePetition, none of this was necessary.  The attorney certified to which address mail should be forwarded, and withdrawal was immediate.  If it was good enough then, why is it different if you are uploading the paper petition?  (The ePetition also had a place to list an email address for the applicant, which the aia0083 lacks.)

Hi Bruce, I couldn't find it either and just filed aia0083.pdf via Patent Center on Apr 5, 2024, and received paper grant on Apr 29, in snail mail. I didn't receive any electronic notification. After I received the paper grant, I can see it via Patent Center since the case is published. I guess one way to keep checking is to log in and see if it has been removed from your docket.

From the Home page, I click on the petitions icon and get three columns, “PETITIONS-PENDING,” “PETITIONS-ALLOWED,” and “PETITIONS-ISSUED”
Under PETITIONS-PENDING there are only 2 options listed: “Petition to make special based on age” and “Petition for Revival of Abandoned Patent Application….”
When I click on the Petitions pull-down menu, I get the same options.
NO ePetition to withdraw as Agent.

Nothing under Existing Submissions that is remotely related either.
I found the thread from January which talked about it not working properly, but I cannot even find the ePetition at all, which doesn’t seem like the issue that was happening in January.

Is that ePetition just GONE from Patent Center?

It’s now > 2 weeks later, and the auto-granted ePetition to Withdraw as Attorney is still not working (yes, we have a POA on file.)  At least EBC admits that it is a known problem with no current solution.  (So we will have to spend even more unremunerated time to file a petition to withdraw from a case which we are withdrawing from because the client lacks the funds to continue.)

I’m a little surprised that no one else on this listserv has mentioned this issue.

We have been attempting to file an ePetition Request for Withdrawal as Attorney or Agent of Record pursuant to 37 CFR 1.36 since last Thursday.  (We have a recognized POA on file.)

We have tried in Chrome, Firefox and Edge.  After completing the form, the attorney can insert the signature in the signature box, but there are no boxes below “First name”,  “Last name” and “Registration number” to fill in, which is likely why nothing happens when  the “Continue” box is pressed.

We have discussed the situation twice with EBC, which escalated the request last Thursday, but still has no answer as to why this is happening.  Today’s agent was aware of one other person who had reported the same problem.  I presume that we can upload, mail or fax a petition to withdraw and wait a few months for it to be granted, but we’d like to be relieved ASAP.

Has anyone else successfully used an ePetition in Patent Center to withdraw as attorney recently?  Has anyone had the same problem we are experiencing and figured out a solution?  (Needless to say, we never had a problem with this in EFS-Web.)
