The power is to set fees such that aggregate revenue matches aggregate costs.
To justify an increased fee on the basis of foregone maintenance fee revenue, is to set fees such that lifetime revenue on an individual patent is made uniform, regardless of the actual cost of processing the patent. Yet the fees and the costs are not the same for every application – the abandoned application is a substantial cost to the USPTO in no way balanced by the revenue from that application.
Maintenance fees are in no way proportionate to cover the costs of post-grant maintenance – I bet those costs are peanuts. Maintenance fees are just a way to claw back money from those who have been successful in prosecuting their case, and to avoid increasing the charges for filing, searching, and examining patents to anything resembling real cost. It is near certain that the revenues from a full term patent exceed the costs of processing that patent as the fees are set so that aggregate revenues and costs are balanced.
The successful subsidise the unsuccessful. It is all very socialist.
Still, the USPTO doesn’t seem to have taken on board the EPO’s trick of charging maintenance fees just for staying in the queue waiting to be examined: so look on the bright side…….

I want to know why it costs the USPTO $2,200 more to handle an application having a benefit claim that is >5 yrs than one with a benefit claim that is <5 yrs and $3,500 to handle an application with a benefit claim >8 yrs.
I call bullsh*t on their assertion that the proposed fee will off-set foregone maintenance fee revenue… If a continuing application has a shorter patent term such that the 11.5 yr MF doesn’t apply, then the USPTO doesn’t have to expend the time and effort to “maintain” the patent. Besides each fee is to recoup the costs for the given thing. Thus, e.g., the application filing fee is to cover the costs of intaking/processing the new application, examination fees to cover the costs for examination, … etc. and maintenance fees are to cover the costs of post-grant maintenance.
This and some other proposed fees look like another money grab by the USPTO so they can dole out money for, e.g., NASCAR sponsorships.

Our patent fees proposal provides additional resources to reflect the budgetary impact of new discounts enacted under the Unleashing American Innovators Act for small businesses, independent inventors, and others who qualify as "small entities" or "micro entities." Additionally, it allows us to maintain efficient operations and support for our 13,000+ employees across the country dedicated to serving American innovators. Both the patent and trademark fee-setting rules will enable the USPTO to accomplish our mission to drive U.S. innovation, inclusive capitalism, and global competitiveness.
