[Patentpractice] USPTO launches new AI Pilot for pre-examination utility application search

 From 37 CFR 1.56(a) "There is no duty to submit information which is not
material to the patentability of any existing claim."  If an examiner
determines that the information does not compel a prima facie case of
obviousness then it is de jure, not material to the patentability of any
claim, right?

If I understand MPEP 609 correctly, this means the documents listed in the
ASRN will be considered, and therefore there is no requirement imposed on
the Applicant to cite documents identified in an ASRN in an IDS to comply
with the rule 56 duties. Do I understand MPEP 609 correctly?

So, again, do I understand MPEP 609 correctly that given the same
consideration as any other document " in Office search files" the citation
of a document in an ASRN does not impose an obligation for the Applicant to
cite that document in an IDS to comply with the rule 56 duty because the
information has de jure been considered ("Will" consider.)?


That is a pretty important question to be certain of the answer, for anyone
receiving an ASRN.
