[Patentpractice] Calculating page count in a US national phase

You only count those parts of the published PCT application that are description, claims, abstract, drawings or sequence listing (so no ISR). My notes about size fees for national phase applications are below (if anyone identifies any errors, let me know):


  1.  Size fee
     *   Based on size of international application as published by WIPO
        *   Size only applies to description, claims, abstract, drawings, and sequence listing.
        *   Size does not include other documents in publication such as ISR, bibliographic sheets, Article 19 amendments, Article 34 amendments, etc.
        *   Language of publication is irrelevant.
     *   The number of pages filed is reduced by 75% for electronically filed applications. This means a size fee is due according to the following table (see MPEP 1893.01(c) and 37 CFR 1.52(f)(2)):

  1.  Applies to anything labeled spec, claims, abstract, or drawings when uploaded.
  2.  NOT recommended to file substitute specifications or replacement drawings with the application because they will be subject to size fee.

For calculating fees in Box 24 on the PTO-1390 national phase transmittal, are we using the PCT publication in its entirety to calculate the number of pages (which usually includes the SR)? I learned to do it that way via the PCT learning center from Carol Bidwell and Gary Smith, back in the day.



Or, are we simply counting the Spec/Claim/Abstract/Drawings we originally submitted in the PCT application and not relying on the publication?

For example, if my PCT publication is 102 pages, then I’d be paying the fee for excess pages.
